Sorry to have to disappoint you guys in letting everyone know that the grass roots forum that actually got all of you guys together as friends (after SD died) is still around. A lot of the mx'rs will get tired of reading the titties, panties and beer topics that seem to be the direction every single thread on here goes in and will fall back. This site is great and has its place for sure and reemer and everyone has done a great job in offering a forum that does not strongly inforce a PG rating like MXC does. There is room for both.

Txmotocross is not a free for all but it does believe in freedom of speech and opinion. The occasional "potty" humor
is going to happen. We have enough rules and regulations in the workplace, it's not fun, so no reason this place has to be over regulated. This site is designed to be informative, fun, and a good representation of our sport but not one persons point of view. It's been a balance of input but most of it
was from the individuals in the industry that have their ears to ground listening. You can only ignore it so long.

Let me chime in as well. I agree w/ everything you just said and think that is great for this site. What I don't agree w/ is bashing another site because the person running that site has a different vision for it than this one. The same freedom you talk about is the same Freedom Jason (Javo) is entitled to as well. Right?

I look at it like this. How many people on here would let me come into your house and tell you want to do? The answer is simple. None.

Jason (Javo) built MxCrazy just as someone built this site. Plain and simple. People complained that the didn't have a place to cuss or post nude pitures etc. ( I don't understand why adults feel the need for that but ok) and he gave you that. People complained they weren't treated the same yada, yada, yada but I NEVER saw a supporting member by their names, EVER.

I thank Jason for doing what he did, as you all should. Think of how many people you have met and the amount of info you received because of MxCrazy.

Honestly Zak, it wasn't. You are in there, that I will admit, but directed just to you, no. I've always said to you in an open forum I think you should have signed up and supported MxCrazy and in returned used it to promote your school. You always chose to ignore that. Firm sues forum to silence critics

In a move that could set a nasty precedent for Australian website operators and their users, a software firm is suing a community website over comments published on its message board.

The firm, 2Clix, is suing the owner of the popular broadband community site Whirlpool, Simon Wright, for "injurious falsehood", asking for $150,000 in damages and an injunction requiring Whirlpool to remove forum threads highly critical of 2Clix's accounting software.

Dale Clapperton, chairman of the online users lobby group Electronic Frontiers Australia, said 2Clix was using the law to silence its critics.

He said if Wright lost "it might mean the end of criticising companies' products and services online", as "any company will be able to demand that people's criticisms of them be deleted off websites, and if they don't comply they'll sue".

Amanda Stickley, a senior law lecturer at the Queensland University of Technology, said if 2Clix won there would be severe consequences for website operators as they would have to be "very vigilant in checking material on the website and remove anything that could cause injury to someone's business reputation".

In a statement of claim filed with the Supreme Court of Queensland, 2Clix said the comments, published in two threads between between late last year and July this year, led it to sustain "a severe downturn in monthly sales".

It specifically referenced more than 30 comments by Whirlpool users, many strongly advising people to avoid the software at all costs and complaining that advertised features were not actually available in the product.

One of the comments cited by 2Clix read: "The software became such a problem that we threw it out recently ... We stuck with it for over two years but in the end the many hundreds of lost hours of work and high stress levels was not worth it."

2Clix claimed the statements were both false and malicious, and said it contacted Whirlpool about the matter this year but Whirlpool refused to take the forum threads down.

Wright did not respond to requests for comment, while a 2Clix spokesman this morning declined to comment.

But Stickley said it would be very difficult for 2Clix to successfully sue Wright for injurious falsehood over comments made by Whirlpool users.

It would have to prove the statements were false, that they were made in malice, that 2Clix actually suffered damage in the form of monetary loss and, critically, that Wright had intended to cause 2Clix monetary loss by allowing the material to remain on the website.

"I don't think you could actually prove that for a web operator, that they personally intended the damage because of their malicious intention, especially when it's posted by a third party that they've got no relationship to," Stickley said.

But Whirlpool isn't taking any chances, asking its users in a statement published on the website to "refrain from doing anything that might expose Simon to contempt of court such as making statements that prejudge the outcome of the case".

The statement said Whirlpool, which has more than 180,000 registered users, believed the case was without merit and that it would "defend the matter vigorously, despite being a community website with little resources".

Whirlpool users have already begun donating money to the site to help Wright cover any legal costs. Some claim to have donated more than $1000 through Paypal.

I wish no ill will or bad blood on mxc or any other site. Javo and I, despite our differing opinions of things, are friends and

He was told on more than one occasion "my way or the highway" on MXC, which, by the way, Javo has every right to do. 11K has the same privledge here for anyone who he feels are abusing rules. My understanding is this site is all about not getting moderated for your opinions. O.K., but do we have to take it to the gutter to test the moderating rules? I'm not trying to be self righteous....I think everyone has lines that they won't cross...well maybe...but it seems to me thats where this site is headed. I'll use Hater and motocoach as examples. I've only met Zak once, but have know Hater for 8-9 years and consider him a good friend. Ya'll are advertising your businesses under your avatars. Hater has two insects humpin' one another...motocoach has "bite my ass" w/ a bare butt. I've known Hater for a long time and will always do business w/ him. It's kind of funny...because all the time I've spent around Hater, I've never heard one...not one... cuss word. Think of the phrase "treated like a step child". Brings up negative conotations. Hater has step kids and I'll promise you... they are treated better than most of your kids. I trust him w/ my kids any day of the week! I think this site is just a place for Hater to blow off steam....but if I didn't know Hater like I do, am I really going to do business w/ someone that's using that avatar?? Motocoach, your advertising to teach "mini" riders motocross...you have an avatar that says "Bite my ass"! Hello...Is any of this getting through? Anyway, I've heard that the general public has a bad perception of the motocross community. One other question...why do ya'll cuss phonetecally? Why not just print it? Ya'll making sure youngun's can read? FLAME ON....I can take it!

While I like to play on the interweb as much as the next guy, I find myself avoiding certain threads, or battles because of my affiliation with V.C. . Sometimes I just have to bite my lip, and let it go. While we make ourselves giggle like school girls with our sophmoric humor, some guy who doesn't get it is saying "Who are these yahoos"? and "do I want my kids anywhere near them"?

record, i'm not doing this solo and this is an all new site. this is a community managed project of which input was taken from local dealers, track owners, promoters, trainers, and racers. this site is not a new version of "11kphotos". it just happens to use my photos, similar to what mxc does. in other words, look at it as a another moto option. there are other moderators besides me and i'm basically "the face with the name"... just like it used to be on mxc.

Like I said, Javo and I are friends. we disagree on alot of website type stuff but we are friends. i think people misread a lot of that stuff on the forums. those "you dont like it, leave" comments where not always directed at me and at the end of the day, had nothing to do with txmotocross.com. if you saw us in person you'd understand what i'm saying. but you also cant compare me to your average user over there either.

With all due respect you probably havent spent much time on other mx forums. This is relatively mild compared to what i'm used to seeing.
I dont have any issues with the avatars or whatnot. if that's how they choose to represent themselves that's ok with me. the only rule, again, is keep it safe for work. It's been my considerable experience that if one has all the facts correct, argueing becomes extremely difficult, hence detrimental to my intentions. You would have been proud of me on the football forum for the up coming game between Southlake Carroll and the team from Miami Florida. I had one of their fans cussing me w/ in two posts. We did kiss and make up and plan on meeting at the game however...at least I think we made up. Maybe it's a trap!!

Well your bait is getting better so maybe those football forums are improving your skills? i've trolled a few forums outside the mx stuff
and its funny to see some of the reactions. then i think of places like motodrive where, to my knowledge, no conversation is ever finished
due to persistent hijacking. my favorite (and I bet Broken Rod can back me up on this) is some of the photography forums, OMG. some of
those guys will post images asking for critique then blast the people for critiquing them.

In hater's defense the cussing isnt a frequent thing unless it has something to do with decompression systems on honda's. he becomes rather passionate about life when those break. just sayn'....

I dont think this is a MXC vs TMX thing as some have put it. Its more of what do you want to get out of a moto forum?

I am not a huge fan of MXC for a variety of reasons.... for example the powers that be choose to selectively edit opinions and users...thats fine. Its Java's ball, he can play with it however he wants.

There are several other things that doesn't feel right about MXC, so I for the most part have chosen to take my ball and play with it elsewhere. So for me, this place seems to offer more of what I want out of a local moto forum. Thats me just me though.

It seems TxMX will let me voice my opinion and make a fool of myself and not ever edit me. I hope they keep it real and let users continue to have the illusion that we run this place. :)

Also , Fuquad made a some points that I tend to agree with, thats to bad too, I'd like to rip you a new one just cause its fun......oh and I'm the same a-hole on all the forums...same as I am in person.
